Politically motivated prosecution of civil activist Aynur Myrzaliyeva

 
On 14 April 2021 a court hearing in the politically motivated case against the civil activist and mother of two children, Aynur Myrzaliyeva from the city of Astana will be held. On 9 March 2021, an investigator of the Investigative Division of the Astana City Police Department, Sadvakasov B., drew up an indictment against Aynur Myrzaliyeva, who is prosecuted under politically motivated Article 405 Part 1 and Part 2 ("organization and participation in an extremist organization").
 
"Grounds" under Article 405 Part 1 "(organisation of an extremist organisation):
 
1) Aynur Myrzaliyeva participated in and called for peaceful protests, for which she was unlawfully prosecuted under Article 488 ("violation of the Law on Peaceful Assembly").
2) On 3 June 2020, she called for peaceful protests on 6 June 2020.
3) On 29 July 2020, in a Telegram chat room that consisted of 18 people, she called on people to attend As in Talapker village (Akmola Region) on the occasion of the completion of a house for the family of Dulat Agadil, a politically murdered human rights activist and blogger.
4) On 9, 10, 21, 22 and 24 September, she called for participation in peaceful protests on 25 September 2020, and distributed flyers on Telegram with the time and location of the peaceful protest.
 
A forensic psycho-philological examination of 29 December 2020 found that “there are signs of participation in the activities, as well as signs of organisation in the activities of extremist organisations "DCK" and "Koshe Partiyasy" in the actions of Myrzaliyeva A.A.”
 
"Grounds" under Article 405 Part 2 "("participation in an extremist organization"):
 
1) On 24 April 2020, Aynur Myrzaliyeva published on Facebook posts posted by Mukhtar Ablyazov.
2) On 21 and 24 May 2020, she posted information on Facebook about a "protest action organised by Koshe Partiyasy activists", thereby actively participating in the activities of the "DCK".
3) On 29 July 2020, Aynur Myrzaliyeva "sent an audio message on Telegram on how to contact the leader of the extremist organisation "DCK" Mukhtar Ablyazov via a video conference platform; explaining how to connect to the "ZOOM" programme for a direct dialogue with the latter".
 
On 18 March 2021, the Deputy Prosecutor of Astana Kilimzhanov E. T. signed the indictment.
 
In its resolution of 11 February 2021, the European Parliament has condemned the abuse of anti-extremism legislation by the Kazakhstani authorities to persecute supporters of the peaceful opposition movements “DCK” and “Koshe Partiyasy” and called on the Kazakhstani authorities "to drop politically motivated charges and end all forms of arbitrary detention, reprisals and harassment against human rights activists,  religious organisations, civil society organisations, trade unions, journalists and political  opposition movements".
