On 12 April 2021, at 10:00 the trial on politically motivated prosecution of Aliya Zhakupova under Article 405 Part 2 ("participation in an extremist organization") will be held. Since 14 December 2020 Aliya Zhakupova has been under house arrest.
Judge: Alkenov Ibragim Yerlanovich.
The indictment was signed by deputy prosecutor of Astana Kilymzhanov Yeldos Toktasynovich.
The indictment was drawn up by the investigator of the Investigation Division of the Astana Police Department, Senior Police Lieutenant Praliyev A.S.
The indictment is based on the fact that:
1). Aliya Zhakupova has repeatedly been held administratively liable under Article 488 ("violation of the law on peaceful assembly") for participating in peaceful protests, "having been notified of the recognition of the "DCK" ("Democratic Choice of Kazakhstan") and "Koshe Partiyasy" movements as extremist organisations".
2). On 14 January 2020, Aliya Zhakupova "took part in a discussion on the exclusion of Bakhyt Tulebayeva from the chat room of the “Koshe Partiyasy” Telegram-chat. In this way, members of the extremist organisation filtered the chats and removed unwanted individuals from the group in order to prevent information leakage".
Somehow these actions " demonstrate the active participation" of Aliya Zhakupova in "Koshe Partiyasy". So we had a discussion in the chat room and so what? We can' t have a discussion? What kind of "prevention of information leakage" can there be in a chat room where there are already thousands and thousands of people? Everything was public there anyway.
3) On 4 June 2020, being a member of the Telegram-chat "DULAT ADMINDERI", "participated in the discussion" about organising a peaceful protest in front of the Prosecutor's Office.
4) On 6 September 2020, being a member of the Telegram-chat "Astana Agadil", called for participation in the peaceful protest of 25 September 2020.
The name of Aliya Zhakupova was mentioned in the European Parliament resolution on the human rights situation in Kazakhstan of 11 February 2021, in which the European Parliament called to stop all politically motivated persecution.
