On 10 February 2021, human rights defender of the human rights movement «Article 14», Abaybek Sultanov, was declared a "suspect" under the politically motivated criminal Article 405 Part 2 ("participation in the activities of an extremist organisation"). The ruling is based on the fact that Sultanov Abaybek "deliberately published on the social network "Facebook" a publication, a statement in support of the organisation "Koshe Partiyasy" for 24 May, 3 and 13 June 2020".
The expert opinion of 13 November 2020 states that in the studied materials "there is information that Sultanov A. is a suspect in the commitment of a criminal offence under Article 405 Part 2 of the Criminal Code of the Republic of Kazakhstan". The ruling was drafted by the senior investigator of the investigation department of the Police Department of Almaty region Tanatarov E.E. The ruling was approved by prosecutor Zharykbasov D.
It is important to emphasise that the news of the secret decision to ban the “Koshe Partiyasy” appeared on 19 May 2020. There was 1 month to appeal, which means the decision did not come into force. So the publications of 24 May, 3 and 13 June could not in fact be the basis of the accusation.
In its resolution of 11 February 2021, the European Parliament mentioned the name of Abaybek Sultanov. The European Parliament expressed concern over the fabrication of a new criminal case for "extremism" and called for an end to all political persecution.
