Political persecution of human rights activist Raigul Sadyrbayeva

 

On 19 February, the Almaty City Court upheld an unlawful and secret decision of the Specialized Inter-District Investigative Court of Almaty of 20 January 2021 on the personal search of human rights activist of the human rights movement "Elimay", Raigul Sadyrbayeva.

In the database of court decisions ("court profile"), Raigul Sadyrbayeva has the status of "convicted" despite the fact that, according to the database of the e-government, Raigul has no criminal record (as of 8 February 2021), and according to the response of the Committee on Legal Statistics of the General Prosecutor's Office of 18 February 2021, she has no criminal cases registered in the unified register of pre-trial investigations database.

At the same time, in the report (dated 26 December 2020) by operative investigator of Almaty Police Department Seitkanov R. N. to the head of the Police Department Taimerdenov D. K. it is written that "operational information" was received by the Department for Combating "extremism" that "citizen "X" being a member of a group of «unidentified individuals» by «prior agreement» is «funding the extremist organization DCK" - "Koshe Partiyasy" within the territory of the Republic of Kazakhstan.

It should be reminded that human rights defender of “Elimay” movement - Raigul Sadyrbayeva, human rights defender of “405” movement - Anna Shukeyeva and her husband Baurzhan Atuzbayev have been politically prosecuted for allegedly "financing extremism" and "other aiding and abetting extremism", with court authorisation for their personal searches having been issued by a secret court on 20 January 2021 and the criminal cases opened in December 2020, but they have not been notified.

The European Parliament resolution on the human rights situation in Kazakhstan of 11 February 2021 mentions the name of Raigul Sadyrbayeva and the human rights movement “Elimay” being subjected to political persecution. The European Parliament called on the Kazakhstani authorities to close all politically motivated cases.
