On 15 February 2021, online trials were held on complaints from Anna Shukeyeva and her husband, Baurzhan Atuzbayev, against unlawful, politically motivated and secret decisions of a Specialized Inter-District Investigative Court in Almaty on the personal searches of Anna and her husband.
Anna Shukeyeva and her husband demanded:
1. Revoke the sanction of the judge of the Specialised Inter-District Investigative Court of Almaty, M. S. Dzharilgasova, dated 20 January 2021, for an order to conduct a personal search.
2. Oblige the prosecuting authority (Almaty Police Department) to remedy the violation by cancelling the order to conduct a personal search dated 20 January 2021.
Judge of the Almaty City Court Batyrov Zhanbolat refused to satisfy the complaints. Prosecutor Rauan Bekbayev asked the court to dismiss the complaints, stating that there were no grounds for their satisfaction.
Political criminal cases were opened against Anna Shukeyeva , her husband and the human rights defender of the “Elimay” movement, Raigul Sadyrbayeva, for allegedly "financing extremism" and "other aiding and abetting extremism", with court authorisation for their personal searches having been obtained by a secret court on 20 January 2021, and the criminal cases opened in December 2020, but they were not notified.
The European Parliament resolution on the human rights situation in Kazakhstan of 11 February 2021 mentions the name of Anna Shukeyeva and the human rights movement "405", that are being subjected to political persecution.
The European Parliament called on the Kazakhstani authorities to close all politically motivated cases. The name of Anna and her husband Baurzhan Atuzbayev was also announced during the debate before the vote on the resolution by MEP Petras Auštrevičius.
