Politically motivated trial of Baghdat Baktybayev

 

On 4 February 2021, a civil activist Baghdat Baktybayev was tried in Shu (Zhambyl region) in a politically motivated criminal case under Article 405 Part 1 and Part 2 ("organization and participation in the activities of an extremist organisation") and Article 296 Part 2 ("illegal production, processing, purchase, storage, transportation without intent to sell narcotic drugs, psychotropic substances and their analogues").

Baghdat Baktybayev was illegally sentenced to 2 years of restricted liberty, a 5-year ban on using social media, $61 for forensic expertise and $132 as a forced payment to “Crime Victim Compensation Fund”.

The case was heard in 3 trials: on 28 January, 1 and 2 February.

The Kazakhstani authorities violated Baghdat's right to an open trial. Baghdat Baktybayev was not brought to the court building, he was connected online, but communication was interrupted.

Civil activists and observers were not allowed to attend the trial as the courthouse was closed under the guise of a "quarantine".

Baghdat Baktybayev has been in the pre-trial detention facility since 2 October 2020 for supporting the opposition movement “Koshe Partiyasy”, participating in peaceful rallies and criticising the Kazakhstani authorities. He participated in humanitarian aid campaign for the family of killed human rights activist Dulat Agadil, observed political trials, was twice fined under politically motivated criminal Article 378 ("insulting a police officer").
